A SUBSTANTIVE DRAFT FOR EASYMIND

Terms of Service

These Terms govern your use of the EasyMind learning website and materials. EasyMind is an unregistered independent project maintained by an individual, not a registered business or separate legal entity. “EasyMind,” “we,” “us,” and “our” refer to this project and its individual maintainer. By using the service, you agree to these Terms. If you do not agree, do not use it. If you are not legally able to agree where you live, ask a parent or legal guardian to review and agree where the law requires.

1. What EasyMind is

EasyMind is being developed as a place to explore subjects, read educational lessons, practice language pronunciation, and learn at your own pace. The current version is a static prototype with browser-local profiles, classes, assignments, progress, and interactive practice. Those records stay in the browser and are not synchronized to EasyMind or other devices. Profiles are not password-protected accounts. Class codes and teacher review only work among profiles in the same browser. Tab status is a temporary signal that an EasyMind page is open and visible or focused; it does not prove attention. The built-in tutor uses fixed local rules and does not call an AI service. The displayed leaderboard remains illustrative and does not represent actual users.

Topics include psychology, behavior, influence, and ways people regulate attention and habits. We teach these subjects to explain how people and brains work; presenting a concept does not mean EasyMind endorses, condemns, recommends, or promises the use of that concept. Learning material is educational information, not a command to use a technique on yourself or another person.

EasyMind is currently available free of charge. The EasyMind software is offered under the GNU General Public License version 3 or later (GPL-3.0-or-later), which permits use, study, modification, and sharing subject to its terms, including its source and copyleft requirements. See the license notice for the full license text. Third-party materials may have separate terms. The GPL grants software freedoms and does not guarantee that every downstream distributor or service provider will charge nothing.

2. Educational information is not professional advice

Lessons are general educational material, not a substitute for advice from a qualified teacher, clinician, counselor, physician, attorney, or other professional. Psychology topics do not diagnose or treat a person or tell you what another person is thinking. If a question involves an immediate safety concern, health decision, or personal crisis, contact a qualified professional or local emergency resource.

We aim to explain ideas clearly and correct errors, but educational content can be incomplete, simplified, or mistaken. You are responsible for how you use general information and for checking important claims against reliable sources.

3. Age and family use

The prototype does not ask for or store a visitor’s age, and the maintainer has not set a minimum age. Parents and guardians should supervise a child’s use and control microphone permission. A host can process connection data, and text to speech may send the text you enter to a voice provider. Microphone recognition is requested in on-device mode only and stays unavailable if local processing is unsupported. Do not submit personal details about a child. COPPA can apply to services directed to children under 13 and to operators with actual knowledge they are collecting a child’s personal information; applicable requirements must be assessed before adding that collection.

4. Using the site and speech features

You may use the EasyMind software as permitted by its GPL-3.0-or-later license. You agree not to disrupt the service, bypass security, misrepresent yourself, upload malicious code, or use the service in a way that violates law or another person’s rights. You must not use any lesson, explanation, example, topic, or other knowledge obtained through EasyMind as part of a malicious purpose. This includes using it to plan, commit, or facilitate a crime; harm, exploit, coerce, manipulate, deceive, threaten, or harass a person; expose someone’s private information; or disrupt or attack a computer system. You may study, discuss, question, and critically examine any subject in good faith. Teaching a subject does not endorse harmful conduct, and this term concerns how you use the service and its material.

Text to speech and speech recognition are browser/device features. You choose whether to use the microphone. EasyMind requests on-device speech recognition only and does not fall back to an online recognition service. If your browser or selected language does not support local recognition, the microphone feature stays unavailable. Available languages, voice quality, and recognition accuracy vary. Text to speech may use the browser, device, or selected voice provider. You are responsible for checking the browser’s privacy notice and settings. Do not speak private or sensitive information into the prototype.

5. Content and intellectual property

EasyMind’s name, visual design, code, original lessons, and other materials are owned by the project maintainer or used with permission, except for third-party material identified with its own terms. We give you a limited, revocable, non-transferable permission to access the site and use its learning material for personal learning. You may quote short portions as permitted by law and with appropriate attribution. You may not copy, sell, republish, or create a competing collection from the service without permission, except where applicable law allows.

The EasyMind software is licensed under GPL-3.0-or-later; the license grants permission to use, study, modify, and share the covered software under its conditions. The license notice is available at LICENSE. The EasyMind name and third-party materials are not automatically licensed under the GPL, and third-party materials may have their own terms. Any separate rights or restrictions must be assessed against the applicable license and law. The current prototype does not accept learner uploads or publish user-generated content. If that changes, terms explaining ownership, licenses, moderation, removal requests, and reporting will be added before that feature launches.

6. Availability, changes, and ending access

The site is provided as it is currently available. Features, lessons, language support, and speech tools may change, be interrupted, or be removed. We may suspend access when reasonably needed to protect the service, investigate abuse, comply with law, or address a security issue. We will give notice of material changes where required. You can stop using the service at any time.

7. Disclaimers and liability

To the extent permitted by applicable law, EasyMind is provided without warranties that it will be uninterrupted, error-free, suitable for a particular purpose, or accurate in every detail. Some jurisdictions do not allow particular warranty exclusions, so those exclusions apply only as far as local law permits.

To the extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the prototype, or for decisions made based on general learning material. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or other non-waivable rights. Any limit in this section applies only to the extent allowed by the law that governs your use.

8. Privacy

The Privacy Policy describes the current prototype’s data practices, including hosting requests and browser speech processing. Read it before using speech recognition. If the two documents conflict on personal-data handling, the Privacy Policy controls that subject.

9. Governing law and disputes

The maintainer has not selected a governing country, state, or court venue for this unregistered prototype, so these Terms do not designate one. The law and courts that apply to a dispute depend on the parties’ locations and applicable law. Nothing here removes a consumer’s mandatory right to bring a claim in another forum or use an available regulator or complaint process. A public release should identify the applicable jurisdiction once the project’s operating location is set.

10. General terms and contact

If part of these Terms cannot be enforced, the remainder continues to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms and the linked Privacy Policy describe the current agreement for the prototype; any additional written agreement must identify the service and parties it covers.
